ПОЛІПШЕННЯ ДЕРЖАВНОГО РЕГУЛЮВАННЯ В ЄС ТА ЙОГО ДЕРЖАВАХ-ЧЛЕНАХ: ДОСВІД ДЛЯ УКРАЇНИ

Розглядається досвід ЄС та його держав-членів щодо поліпшення державного регулювання. З цією метою аналізуються результати проведеного у 2019 р. Організацією економічного співробітництва та розвитку дослідження практик ефективного регулювання в ЄС. Робиться висновок про те, що досвід ЄС та його держав-членів у розробленні та імплементації політики поліпшення державного регулювання, зокрема концепції ефективного регулювання, є корисним для України. У зв'язку з цим виділяються такі законодавчі та інституційні складники цього досвіду: залучення зацікавлених сторін до процесу розроблення та імплементації регуляторної політики; виділення попереднього та остаточного етапів процесу оцінювання регуляторного впливу всіх регуляторних актів; регулярне та систематичне оцінювання ex ante (попереднє) та ex post (ретроспективне) законодавчих та регуляторних актів на основі спеціально розробленої надійної науково обгрунтованої методології; оцінювання регуляторного впливу та залучення зацікавлених сторін у процесі транспонування директив ЄС до національного законодавства держав-членів; запровадження систематичного регуляторного нагляду та контролю якості інструментів управління регулюванням.
