ADMINISTRATIVE RESPONSIBILITY FOR VIOLATION ОF TRAFFIC RULES UNDER MARTIAL LAW

Abstract

The article investigates the problematic issues of administrative responsibility for violation of traffic rules under martial law. The reasons for the increased danger of the car are described. The processes that took place on the roads with the beginning of the full-scale invasion are investigated. The article describes in detail how and on which services it is possible to find out about the fact of fixing a violation in the field of road safety, recorded in automatic mode. The full list of administrative offenses in the field of road safety is listed. The tasks of the Code of Administrative Offences in the studied area are outlined. Article 33 of the Code of Ukraine on Administrative Offences is analyzed. Among the circumstances aggravating liability for an administrative offense, according to paragraph 5 of Article 35 of the Code of Ukraine on Administrative Offenses, the commission of an offense in conditions of natural disaster or other extraordinary circumstances is recognized. The concept of extraordinary circumstances is described in detail. An extraordinary circumstance is an incident and phenomena of social, natural, man-made, military origin, the facts of the introduction of a state of emergency and martial law, in the presence of which conditions are created for the settlement of which there is a need for additional measures of political, legal, organizational, technical and other nature, their resource support in order to normalize the situation as soon as possible and at the lowest cost. Thus, committing an administrative offense under martial law is an aggravating circumstance. The article also contains a description of the draft laws that provide for the strengthening of administrative responsibility of drivers for violation of traffic rules under martial law.
