CONTENTS OF THE PROVISION OF SERVICES IN THE FIELD OF STATE REGISTRATION OF REAL RIGHTS TO REAL ESTATE

Abstract

The scientific article is devoted to the coverage of services, the ratio of public and administrative services provided in Ukraine. Taking into account normative legal acts and the state of scientific development, the features of services in the field of state registration of property rights to real estate are highlighted. It is proposed that the content of services in the field of state registration of property rights to immovable property should be understood as the result of the activity of public administration bodies regulated by legal acts, in particular judicial authorities, the notary regarding property rights to immovable property from consideration of the application of a natural or legal person for the issuance of an administrative act (permit ( license), certificate, certificate, etc.), aimed at ensuring his rights and legal interests and/or at the person's performance of duties defined by law. Taking into account the opinions of scientists regarding the understanding of services in the field of state registration of property rights to immovable property, the signs are distinguished: public interest; direct initiative (application) of individuals and/or legal entities; recognition of the validity of real estate rights; territoriality; publicity of state registration of rights; legal character; the result is the issuance of an individual administrative act (certificate, permit, license, decision of the body on registration, etc.); the responsibility of officials and employees for nonfulfillment or improper fulfillment of the duty to provide public services in the field of state registration of property rights to immovable property. It is emphasized that the subject of legal relations is the state registration of property rights to real estate and their limitations. According to Art. 5 of the Law of Ukraine "On State Registration of Property Rights to Immovable Property and Their Encumbrances" to objects of immovable property, in respect of which state registration of rights is carried out, include: land plots, as well as objects of immovable property located on a land plot, the movement of which impossible without their depreciation and change of purpose, namely: enterprises as single property complexes, residential buildings, buildings, constructions (their separate parts), apartments, residential and non-residential premises.
