TYPICAL OPERATING AND SEARCHING SITUATIONS AND VERSIONS WHEN DETECTING PREPARATION FOR PERMITTING MURDER ON ORDER ON DOMESTIC LAND

Abstract

The article is devoted to the investigation of operational and investigative situations and versions that arise when preparation for contract killing is detected on domestic grounds. The actual concept of an operational-search situation is provided – a set of objective and subjective factors, within certain space-time limits regarding the received information or the activity of an individual (persons), which should be the subject of research by operative units. It is indicated that after an operational-investigative situation arises, an employee of the operational unit must carry out intellectual activity regarding the assessment of the relevant situation, the formation of conclusions on the basis of the information received and further prospects for the prevention of crime, as well as decision-making regarding what actions must be taken. In order to make a quick, complete and effective decision, it is necessary to make the most accurate conclusion regarding the received information. With this in mind, forensic versions have been selected, which can be considered as template conclusions, which, with the received operational information, allow you to quickly determine what actions should be taken. Depending on the direction of the person's activities in preparation for such a crime as contract murder on domestic grounds, the following typical operative and investigative situations were identified: obtaining information about the person's desire to purchase items that are planned to be used as a tool or means during the commission of contract murder on household soil; receiving information that indicates the search by the person of the perpetrator of contract murder on domestic grounds; receiving information about possible threats to commit such a crime as murder within the same family; obtaining information about the consequences of actions that clearly indicate preparation for the possible commission of a contract murder on domestic grounds. Operative-investigative versions regarding the preparation for the commission of a murder on domestic soil can be divided depending on such a criterion as the determination of the person's intentions regarding the preparation for the commission of a murder on domestic soil: versions regarding establishing the presence of criminal intent in a person; versions that do not have specific specifics regarding the type of criminal offense that may be evidenced by the information received by operatives of the operative unit; versions of a generic nature, typical for the murder of a person (which are related to the motive, means, method of commission, etc.); versions regarding the specifics of preparing for a contract killing on domestic soil.
