ADMINISTRATIVE AND LEGAL REGIME OF THE USE OF SOLAR ENERGY FACILITIES IN UKRAINE IN THE LIGHT OF ENSURING THE VIABILITY REQUIREMENTS OF POPULATED POINTS

Abstract

The relevance of the topic of this scientific publication is justified by the need to solve the issue of ensuring Ukraine's energy independence, restoring the state energy system to ensure the effectiveness of the state and regional development strategy. The authors emphasized that the introduction of the latest technologies, the use of which allows overcoming the energy problems of the modern world, including the energy resource supply problems of Ukraine, requires the development and introduction of an appropriate regulatory and legal basis for their use, which justifies the relevance of this scientific publication. The purpose of the article is to establish the content and features of the administrative and legal regime for the use of solar energy facilities in Ukraine in the light of ensuring the viability of settlements. The authors determined that the legality of the origin and further use of electric energy produced by using solar radiation must comply with the provisions of the Procedure for issuing, using and terminating the guarantee of the origin of electric energy for business entities that produce electric energy from alternative energy sources. The authors determined that solar radiation is a unique natural resource that, according to its administrative and legal regime, is different from the use of other so-called "traditional" resources, despite its relative inexhaustibility and relative availability for everyone and everywhere in the world. That is why the use of solar radiation should be regulated not only at the level of the domestic legal system, but also at the level of international legal acts. The authors concluded that the circulation of electric energy produced by using solar radiation as a relatively inexhaustible public natural resource is carried out on the basis of a contract that has a public nature of legal regulation and does not require obtaining a special permit in the case of using it for one's own needs, and the imperative of obtaining permits documents – in the case of realizing the intention of making a profit from its sale.
