GENESIS OF CONCEPTS OF HONOR AND DIGNITY OF A PERSON AS OBJECTS OF CRIMINAL PROTECTION

The purpose of the work is to determine the peculiarities of the genesis of the concepts of honor and dignity of a person as objects of criminal legal protection and to provide proposals for improving the criminal legislation of Ukraine. Methodology. To achieve the purpose of the work, dialectic and historical and legal methods were used. Scientific novelty. For the first time, it was proposed to define the concepts of honor and dignity of a person in a separate norm in Section 3 «Criminal offenses against the will, honor and dignity of a person» of the Special Part of the Criminal Code of Ukraine. Further development of the study of the genesis of the concepts of honor and dignity of a person as objects of criminal protection has been further development. These concepts arose with the beginning of a person's awareness of his personality. The emergence of a sense of dignity, as well as selfesteem and honor, took place in the later stages of the development of primitive society. Ideas about human dignity began to form during the decomposition of slave-owning society and received their further development in feudalism. With the development of capitalist industrial relations, the idea of honor and dignity has changed. For the first time, the ideologues of the Renaissance put forward and developed the category of human dignity. Categories of dignity and honor have historically evolved independently as separate concepts. The current legislation of Ukraine does not contain the definition of concepts of honor and dignity. The definition of general concepts of honor and dignity of a person in the Criminal Code of Ukraine will provide opportunities to provide in special norms enhanced criminal liability for insignia in honor and dignity of certain categories of persons, in particular, law enforcement officers. Conclusions. The lack of legislative definition of the concepts of honor and dignity of a person does not contribute to the correct application of the provisions of normative legal acts that provide for liability for insentation of these objects.
