THE RIGHT TO HEALTH CARE: TO THE ISSUE OF SOCIAL PROTECTION OF PEDAGOGICAL AND SCIENTIFIC-PEDAGOGICAL WORKERS IN THE CONDITIONS OF THE COVID-19 PANDEMIC

Abstract

The aim of the article was to consistently implement the constitutional principles of the social state in Ukraine in addressing the issue of guaranteeing the right to health care in terms of social protection of pedagogical and scientificpedagogical workers from coronavirus disease (COVID-19). The scientific substantiation of the Draft Laws developed by the author of the article and submitted to the Verkhovna Rada of Ukraine is provided, namely on amendments to some laws of Ukraine on additional financial support of pedagogical and scientific-pedagogical workers for the quarantine period established by the Cabinet of Ministers of Ukraine. on the territory of Ukraine coronavirus disease (COVID-19) register. № 4021-1 dated 21.09.2020 and the register. № 4022-1 dated September 22, 2020. The author summarizes that even in the case of adoption of these draft laws in the proposed version, all the same pedagogical and scientific-pedagogical workers working in state and / or municipal educational institutions will not receive social protection at the same level as medical workers in Ukraine. However, in relation to this group of workers, it will provide an opportunity to promote the outflow of personnel from a socially important profession. A number of social guarantees for pedagogical and scientific-pedagogical workers working in state and / or municipal educational institutions, developed by the author of the article and proposed to the Parliament of Ukraine given: a) importance and responsibility of work performed by employees of educational institutions in quarantine measures it should be taken into account that they also train medical workers); b) the urgency of the revision of wages and social guarantees of these employees; c) the need to “level” the approach initiated by the Ministry of Health of Ukraine regarding the application of sanctions to this group of employees in the form of dismissal without pay, and the complete lack of social guarantees that they should count on when doing their hard work in conditions of quarantine, which makes it also dangerous for their own life and health, as well as for the life and health of all members of their family living with them.
