THE ROLE OF THE COUNCIL OF EUROPE BODIES IN THE PROTECTION OF CONSTITUTIONAL HUMAN RIGHTS IN UKRAINE: DIRECTIONS OF MODERN RESEARCH

Abstract

This study is dedicated to identifying new challenges in the protection of constitutional human rights in Ukraine and the role of the Council of Europe bodies in ensuring their adherence. It examines the terminological nuances of certain concepts within the researched topic to improve existing terminological traditions in Ukraine and to ensure the correct use of the terminological apparatus. At the same time, the work aims to highlight the legal realities in Ukraine, current scientific achievements, and challenges in the practice of law enforcement. The study provides a structured doctrinal and practical exposition of the circumstances and root causes of the researched issues based on primary sources. An analysis of primary documents and contemporary real cases of the need to protect constitutional human rights is conducted, and accordingly, one of the solutions to the situation regarding the right to an effective remedy is proposed. Further directions for empirical, comparative, and somewhat critically analytical review of the legal reality in Ukraine are outlined. It is noted that Ukraine's unique experience in protecting human rights under martial law could be useful in the event of similar challenges arising on the European continent. It is concluded that the role of the Council of Europe bodies in the protection of constitutional human rights in Ukraine is crucial through monitoring compliance with human rights, providing consultations, and developing mechanisms and tools for their protection. The importance of systematic observation of the human rights situation, objective assessment, and the ability to take measures for improvement is emphasized. The article concludes that the chosen research topic is urgent, complex, and justified in terms of the need to improve legal mechanisms to ensure the protection of constitutional human rights amid modern challenges and threats.
