REGULATORY AND LEGAL REGULATION OF THE REPRESENTATION OF A CITIZEN AND THE STATE IN AN ADMINISTRATIVE COURT

Abstract

The purpose of the scientific article is to establish regulatory and legal regulation of the representation of a citizen and the state in an administrative court. It is substantiated that the regulatory and legal support of the relations of representation of the interests of a person and the state in an administrative court is carried out at several levels: the constitutional level, where the fundamental principles for determining the right of a person to judicial protection are established; the level of conceptual and strategic acts, where the directions of reforming the judicial system and protecting the rights and freedoms of a person in administrative proceedings in particular are established; the legislative level, which reflects the procedural status of the representative, the grounds for its emergence and termination; the subordinate regulatory and legal level, which reflects. It is justified to introduce a legislative requirement to provide, if necessary, additional reasonable terms for familiarization with the case materials in the event of replacing an official or official who performs the functions of representing the interests of an individual and the state in an administrative process. It is determined that the author's proposal to improve the regulatory and legal regulation of the relations of representing the interests of an individual and the state in an administrative court requires amendments to Article 55 of the Administrative Procedure Code of Ukraine by supplementing it with paragraphs two and three of part three of Article 55 in the following wording: «If there are good reasons, a legal entity has the right to replace the person representing its interests in a dispute. A reasonable term may be granted to familiarize with the case materials to a person replacing the representative of a legal entity in a case upon request».
